General Terms and Conditions (GTC) - Kayak courses, kayak camps and rafting:

Booking:

Bookings are made in writing, verbally or using the web order form. The contract is concluded by the written booking confirmation of the user of these GTC. Verbal collateral agreements are non-binding. By making a booking, the participant accepts the following terms and conditions as an integral part of the contract. General terms and conditions of the participant are only valid if they are recognized by us in writing. The contents of the contract are the respective service contents published on the homepage at the prices advertised there. All prices are per person, unless otherwise specified. A deposit of 50% of the course price is due upon confirmation of the booking. The respective total price must be paid in full by the start of the course.

Vouchers:

Vouchers become valid upon payment of the amount shown on the voucher.

Cancellation policy:

If the customer withdraws from the contract, the following cancellation costs will be charged regardless of the reason for withdrawal:

Kayak courses and camps

Up to 30 days before the start of the course 10% plus EUR 20.00 administration fee
Up to 14 days before the start of the course 30% of the respective course price
Up to 7 days before the start of the course 70% of the respective course price
Until directly before the start of the course 100% of the respective course price

Rafting

From booking up to 1 week before the booked tour: 10%
From one week before the booked tour: 25%
From 3 days before the booked tour: 50%
From 1 day before the booked tour: 75%
On the day of the booked tour: 100%

If a course or rafting tour cannot be carried out due to external, non-operational obstacles, the organizer is responsible. In this case, the participant is entitled to make up for the booked service within one year. There are no further claims.

Participation requirements:

The participant warrants that he/she has the necessary mental and physical condition for the respective course or rafting tour.

Persons impaired by medication, alcohol or addictive substances are excluded from the course.

The participant must check the equipment provided for completeness and optimal fit. Any damage or other defects must be reported to the course instructor immediately.

The participant declares that he/she is able to swim in both still and flowing water. Irrespective of the instruction and hazard information provided by the instructor prior to the start of the course, the participant acknowledges that the nature of the activity is hazardous.

Complaints:

Complaints regarding the type and duration of the respective course/rafting tour must be reported immediately to the course instructor or the organizer. Complaints must be made no later than 4 weeks after the start of the course.

Liability:

After the course instructor/raft guide has given proper instruction and explained the dangers, participation in all courses and tours is at the participant's own risk. Liability for all damages for any legal reason whatsoever towards the organizer and the course leaders/raft guides is limited to gross negligence and intent. In the case of consumer transactions within the meaning of the Austrian Consumer Protection Act (KSchG), this only applies insofar as these damages do not relate to personal injury. The participant is liable for the return of and damage to the organizer's equipment due to improper handling.

Other:

The participant must follow all safety instructions given by the instructor/raft guide. Participants are obliged to show consideration for each other. The instructor/raft guide is entitled to exclude participants who violate these terms and conditions from the course or tour. Austrian law applies. The place of fulfillment and jurisdiction is Innsbruck, unless otherwise stipulated by law.

Payment:

Payment for goods delivered by us is possible in cash, by Paypal or on account.
In the case of untraceable delivery addresses or higher order values, we reserve the right to deliver only against prepayment or cash on delivery.

Data protection:

Your data will not be passed on to third parties. They are used exclusively for purchase and contract processing.

Retention of title:

We reserve title to the delivered goods until the purchase price has been paid in full.

Delivery/shipping:

Shipping is carried out by GLS or a forwarding agent. We ship to your home address or a different delivery address. The risk of loss or damage is transferred from the carrier to you upon acceptance of the parcel.
Therefore, please check the shipment immediately upon receipt to ensure that it is intact and complete. If the parcel has been damaged, make a complaint to the carrier immediately and inform us!

Cost bearing of the return costs in case of revocation by the buyer:

In the event of a revocation, the buyer shall bear the regular costs of the return shipment if the delivered goods correspond to those ordered.

Prices:

All prices in our online store are in EURO.

Shipping costs:

For deliveries with a value of less than € 100.00 we charge € 5.00 postage and packaging within Austria. For deliveries with a value of less than € 100.00 we charge € 6.00 postage and packaging fee to Germany.
Deliveries over € 100.00 are free of charge within Austria and Germany (please inquire about shipping costs to other European countries by email).
Exception: Boats and paddles - actual shipping costs will be charged (please inquire by email before purchasing).

Conclusion of contract:

A purchase contract is only concluded when we accept your order. This is done by sending you an e-mail with the notification that we have sent the goods to you, or if no such notification is sent, by sending the goods.

Other:

Austrian law shall apply. The place of performance and jurisdiction is Innsbruck, unless otherwise provided by law.
