General Terms and Conditions (GTC) - Kayak courses, kayak camps and rafting:

Posting:

The booking is made in writing, orally or by means of a web order form. The contract is concluded by the written booking confirmation of the user of these GTC. Verbal agreements are not binding. With the booking, the participant acknowledges the following terms and conditions as part of the contract. General terms and conditions of the participant are only valid if they are accepted by us in writing. The contents of the contract are the respective service contents published on the homepage at the prices advertised there. All prices are per person, unless otherwise specified. With the booking confirmation a deposit of 50% of the course price is due. The respective total price is to be paid in full by the time the course begins.

Vouchers:

Vouchers become valid upon payment of the respective voucher amount shown.

Cancellation Policy:

If the customer withdraws from the contract, the following cancellation fees will be charged regardless of the reason for withdrawal:

Kayak courses and camps

Up to 30 days before course start 10% plus EUR 20,00 handling fee
Up to 14 days before course start 30% of the respective course price
Up to 7 days before the start of the course 70% of the respective course price
Up to 3 days before the start of the course 100% of the respective course price

Rafting

From the booking until 1 week before the booked tour: 10%.
From one week before the booked tour: 25%.
From 3 days before the booked tour: 50%.
From 1 day before the booked tour: 75%.
On the day of the booked tour: 100%

The organizer is responsible for the non-realization of a course or a rafting tour due to external obstacles that have no operational connection. In this case, the participant is entitled to make up for the booked service within one year. Further claims do not exist.

Participation Requirements:

The participant assures to have the necessary mental and physical condition for the respective course or rafting tour.

Persons impaired by medication, alcohol or addictive substances are excluded from the course.

The participant has to check the equipment provided to him for completeness and optimal fit. Damage or other defects are to be reported to the course instructor immediately.

The participant declares to be able to swim both in standing and flowing water. Notwithstanding the instructor's briefing and hazard information prior to the start of the course, the participant acknowledges that the nature of the activity is hazardous.

Complaints:

Complaints regarding the type and duration of the respective course/rafting tour must be reported immediately to the course instructor or the organizer. Claims for complaints must be made no later than 4 weeks after the start of the course.

Liability:

After proper training and hazard information by the course leader / raft guides, participation in all courses and tours is at your own risk. The liability for all damages for any conceivable legal reason is limited to gross negligence and intent towards the organizer and the course leaders/raft guides. In the case of consumer transactions within the meaning of the KSchG, this applies only insofar as these damages do not concern personal injury. The participant is liable for the return as well as for the damage to equipment of the organizer due to improper handling.

Other:

The participant has to follow all safety instructions of the course instructor/raft guide. The participants are obliged to show consideration for each other. The course leader/raft guide is entitled to exclude participants who violate these terms and conditions from the course or tour. Austrian law applies. The place of fulfillment as well as the place of jurisdiction is Innsbruck - unless otherwise stipulated by law.

Payment:

The payment of goods delivered by us is possible in cash, via Paypal or on account.
In the case of untraceable delivery addresses or higher order values, we reserve the right to deliver only against cash in advance or cash on delivery.

Privacy:

Your data will not be forwarded to third parties. They are used exclusively for the purchase and contract processing.

Retention of Title:

We retain ownership of the delivered item until the purchase price has been paid in full.

Delivery/Shipping:

Shipping is done by GLS or freight forwarding. We ship to your home address or a specified, different delivery address. With the acceptance of the package, the risk of loss or damage passes from the carrier to you.
Therefore, please check the shipment immediately upon acceptance for integrity and completeness. If the package is damaged, claim this immediately to the carrier and inform us!

Cost bearing of the return costs in case of revocation by the buyer:

In the event of a revocation, the buyer shall bear the regular costs of the return shipment if the delivered goods correspond to the ordered goods.

Prices:

All prices in our online store are in EURO.

Shipping costs:

For deliveries below a value of goods of € 100,00 we charge within Austria € 5,00 postage and packaging flat rate. For deliveries below a value of goods of € 100,00 we charge € 6,00 postage and packaging flat rate to Germany.
Deliveries over € 100,00 are free of charge within Austria and Germany (please ask for shipping costs to other European countries by email).
Exception: boats and paddles - actual shipping costs will be charged (please ask by email before purchase).

Conclusion of contract:

A purchase contract is only concluded when we accept your order. This happens by sending you an e-mail with the notification that we have sent the goods to you, or in the absence of such notification, by sending the goods.

Other:

Austrian law shall apply. The place of performance as well as the place of jurisdiction is Innsbruck - unless otherwise stipulated by law.
